Milwaukee County’s TAD Program will be implemented and guided by the standards on release and diversion developed by the National Association of Pretrial Services Agencies. The project goals in collaboration with the District Attorneys and courts is to divert people in need of substance abuse services from the criminal justice process into community based social and treatment services, reduce the number of people in need of substance abuse services in the Milwaukee County jail, and reduce the number of substance abusing defendants sent into the state prison system from Milwaukee County.

Diversion Specialists will:

  • Screen all new arrest bookings into the Milwaukee county jail
  • Determine TAD eligibility and conduct a face-to-face interview to determine whether the person meets all admission criteria
  • Complete the risk assessment tool
  • Verify all information using available systems (CJIS/CCAP) and/or third party contacts
  • Summarize findings of the interview and assessment process in a written form to be submitted to the district attorney and defense attorney
  • Prepare a Diversion Agreement that outlines the review date (program duration), possibility of extension/termination, voluntary nature of the program, and all general and required conditions of the program

For those individuals who are not diverted pre-charging, the Diversion Specialist’s summary findings may be reviewed at subsequent court hearings such as the initial appearance, preliminary hearing, pretrial, arraignment and/or projected guilty plea/sentencing.  The individual may be considered for deferred prosecution/sentencing at any of these points.  If appropriate and agreed upon, the Diversion Specialist will prepare the Diversion Agreement as outlined above.
